Terms of Service

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order, you represent that you meet this requirement and that the information you provide is accurate.

2. Orders and Acceptance

Your placement of an order is an offer to purchase. We may accept, decline, or limit any order in our sole discretion, including for reasons of suspected fraud, pricing error, product unavailability, or geographic restriction. If we decline an order after payment has been captured, we will refund the captured amount in full.

3. Pre-Orders

Some products are sold on a pre-order basis. The following terms apply specifically to pre-orders and are intended to align with the U.S. Federal Trade Commission’s Mail, Internet, or Telephone Order Merchandise Rule (16 C.F.R. Part 435):

• Payment. Full payment is captured at the time of order, unless otherwise stated on the product page.
• Estimated shipping. Each pre-order product page lists an estimated ship-by window. These are estimates; actual delivery times may vary based on manufacturing and supply conditions. Where no specific time is stated, we will ship within 30 days of your order.
• If we cannot ship within the stated time. If we anticipate that we cannot ship within the stated (or 30-day) period, we will send you a delay notice by email identifying the new shipping date and offering you the choice either to consent to the delay or to cancel your order for a full refund. Until you respond, we will treat your silence, beyond the original estimated ship date, as a request to cancel and will refund your payment in full.
• Cancellation before shipment. You may cancel a pre-order at any time before the order has shipped by contacting us at the address below. Once a pre-order has shipped, our standard returns policy applies.
• Refund timing. Refunds for cancelled pre-orders are issued to the original payment method within seven (7) business days of cancellation, or within one billing cycle for charges placed on a credit card.

4. Pricing and Payment

All prices are listed in U.S. dollars unless otherwise indicated and are exclusive of applicable taxes, shipping, and duties, which are added at checkout. We reserve the right to change prices at any time, but changes will not affect orders that have already been accepted.

Payment is processed by our payment processor (Shopify Payments and its underlying networks). By submitting payment information, you authorize us to charge the payment method for the order total, including any applicable taxes, shipping, and duties.

5. Shipping and Delivery

We ship to addresses within the regions listed at checkout. Risk of loss and title pass to you upon delivery to the address you provided at checkout. If your order arrives damaged or fails to arrive, contact us at the address below and we will work with the carrier to resolve the issue at no cost to you. Estimated delivery times are provided for convenience and are not guaranteed.

6. Returns and Refunds

Eligible items may be returned within 14 days of delivery, provided they are unworn, unwashed, undamaged, and accompanied by original tags and packaging. To initiate a return, contact us at the address below.

Refunds are issued to the original payment method after the returned item has been received and inspected. Outbound shipping costs are non-refundable; return shipping is the customer’s responsibility unless the return is the result of our error or a defective product.

Final-sale items (clearly designated on the product page) and pre-orders that have already shipped follow the same 14-day window after delivery.

Defective or damaged products. If your order arrives defective or damaged, contact us within 14 days of delivery with your order number; photographs help us resolve quickly but are not required. You may choose either a replacement (subject to availability) or a full refund at no cost to you, including return shipping.

7. Product Descriptions

We describe each product as accurately as we can. Colors, finishes, and other details may appear differently on different screens. Each piece is handmade or made in small runs; minor variations between items are expected and not defects.

8. Intellectual Property

The Site and its contents — including text, graphics, photographs, illustrations, logos, trademarks, and the underlying code — are owned by Desrosiers Atelier or its licensors and are protected by U.S. and international intellectual property laws. You may use the Site for personal, non-commercial purposes only. Any other use, including reproduction, distribution, modification, or commercial exploitation, requires our prior written consent.

9. User Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Site, our systems, or other users’ accounts
• Scrape, crawl, or otherwise harvest content from the Site without permission
• Interfere with the operation of the Site or impose an unreasonable load on our infrastructure

10. Disclaimers

Except as expressly stated in these Terms, the Site and the products are provided “as is” and “as available” without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will Desrosiers Atelier, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with the Site or any product. Our total liability for any claim arising out of or in connection with a product is limited to the amount you paid for that product.

Some jurisdictions do not allow the exclusion or limitation of certain damages; the limitations above apply only to the extent permitted by applicable law.

12. Indemnification

You agree to indemnify and hold harmless Desrosiers Atelier and its officers, directors, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your breach of these Terms or your misuse of the Site.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any consumer rights you may have under the laws of your jurisdiction that cannot be waived.

14. Changes to These Terms

We may update these Terms from time to time. The “Effective” date at the top of this page reflects the latest version. Continued use of the Site after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
